These Terms of Service govern your use of the Zootify website and your purchase of products from Zootify.

Zootify is operated by TRose Enterprises LLC, 75 E 3rd ST, Sheridan, WY 82801, USA.

By accessing or using the website, you agree to these Terms.

1. Eligibility

You must be legally capable of entering into a binding agreement to use this website and purchase products.

If you are using the website on behalf of another person or organization, you represent that you have authority to bind that person or organization.

2. Website Use

You agree not to:

  • Use the website for unlawful purposes; 

  • Attempt to interfere with website security; 

  • Access systems or data without authorization; 

  • Introduce malicious code; 

  • Scrape or copy website content through unauthorized means; 

  • Impersonate another person or entity; or 

  • Use the website in a manner that could damage Zootify or its customers. 

3. Product Information

We make reasonable efforts to ensure product descriptions, images, dimensions, colors, specifications and other information are accurate.

However, minor differences may occur, including differences caused by display settings, manufacturing variations or updates to products.

4. Prices

Prices are displayed in US dollars unless otherwise stated.

Zootify reserves the right to correct pricing errors and to modify prices at any time before an order is accepted.

5. Orders

Submitting an order constitutes an offer to purchase.

Zootify reserves the right to accept, reject or cancel an order where permitted by law, including in cases involving:

  • Pricing errors; 

  • Inventory errors; 

  • Suspected fraud; 

  • Unauthorized transactions; 

  • Incorrect product information; or 

  • Other legitimate operational reasons. 

If we cancel an order after payment has been received, we will issue an appropriate refund.

6. Payments

Payments are processed through third-party payment providers.

Zootify does not generally receive or store complete payment-card information.

7. Taxes

Applicable sales taxes and other required charges may be calculated and collected at checkout based on the customer's location and applicable law.

8. Shipping

Orders are generally processed within 1–2 business days and standard delivery is estimated at 3–7 business days after shipment.

Shipping is subject to the Zootify Shipping Policy.

9. Returns and Exchanges

Returns and exchanges are governed by the Zootify Returns & Refunds Policy and Exchange Policy.

10. Warranty

Products carrying an express warranty are governed by the Zootify Warranty Policy.

11. Intellectual Property

All content on the Zootify website, including trademarks, logos, photographs, graphics, product descriptions, text, designs and other materials, is owned by or licensed to Zootify or its applicable licensors.

You may not reproduce, distribute, modify or commercially exploit such content without prior written permission.

12. User Content

If you submit reviews, photographs, comments, testimonials or other content to Zootify, you represent that you have the right to submit that content.

To the extent permitted by law, you grant Zootify a non-exclusive, worldwide, royalty-free license to use, reproduce, display and distribute such content for legitimate business and marketing purposes.

13. Third-Party Services

The website may use third-party services for payment processing, analytics, advertising, fulfillment, shipping, customer support and other functions.

Your use of third-party services may also be subject to those providers' terms and policies.

14. Third-Party Links

The website may contain links to third-party websites.

Zootify is not responsible for the content, availability, security or privacy practices of third-party websites.

15. Disclaimer

To the maximum extent permitted by law, the website and its content are provided on an "as available" basis.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Zootify and TRose Enterprises LLC will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the website or purchase or use of products.

To the extent permitted by applicable law, the total aggregate liability of Zootify and TRose Enterprises LLC arising out of or relating to your use of the website, or your purchase or use of any product, will not exceed the greater of (i) the amount you paid to Zootify for the product or service that gave rise to the claim, or (ii) one hundred US dollars (USD $100).

Nothing in these Terms limits liability that cannot legally be limited or excluded.

17. Dispute Resolution; Binding Arbitration; Class Action Waiver

Please read this section carefully. It affects your legal rights and requires most disputes between you and Zootify to be resolved by individual, binding arbitration rather than in court.

Informal Resolution. Before filing a claim against Zootify, you agree to first contact us at support@zootify.com and attempt in good faith to resolve the dispute informally. Most disputes can be resolved this way.

Agreement to Arbitrate. If a dispute is not resolved within 30 days of that notice, you and Zootify agree that any dispute, claim or controversy arising out of or relating to these Terms, the website, or any product or service purchased from Zootify will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court.

Class Action Waiver. You and Zootify agree that any arbitration or proceeding will be conducted only on an individual basis and not as a class, collective, consolidated or representative action, and neither you nor Zootify may participate as a plaintiff or class member in any purported class or representative proceeding.

Opt-Out Right. You may opt out of this arbitration agreement by emailing support@zootify.com within 30 days of first accepting these Terms, stating your name and that you wish to opt out of arbitration.

Time Limit on Claims. Any claim arising out of or relating to these Terms or your use of the website must be filed within one (1) year after the claim arises, unless a longer period is required by applicable law.

This section is governed by the Federal Arbitration Act.

18. Copyright Complaints (DMCA)

If you believe that content on the Zootify website infringes your copyright, you may send a written notice to our designated agent at support@zootify.com that includes:

  • Identification of the copyrighted work you claim has been infringed;

  • Identification of the material you claim is infringing and its location on the website;

  • Your name, address, telephone number and email address;

  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and

  • A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Zootify will review and respond to properly submitted notices in accordance with the Digital Millennium Copyright Act (DMCA).

19. General Provisions

Severability. If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement. These Terms, together with the policies referenced in them, constitute the entire agreement between you and Zootify regarding your use of the website and supersede any prior agreements.

No Waiver. Zootify's failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms without Zootify's prior written consent. Zootify may assign or transfer these Terms without restriction and without notice to you.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Zootify, TRose Enterprises LLC and their applicable personnel and service providers from claims arising from your unlawful use of the website, violation of these Terms, or infringement of another party's rights.

21. Modification

Zootify may update these Terms from time to time.

The updated version will be posted on the website with a revised "Last Updated" date.

22. Governing Law

These Terms will be governed by the laws applicable in the State of Wyoming, without regard to conflict-of-law principles, except to the extent applicable consumer protection laws require otherwise.
